By creating an account or using the VoiceFlow AI platform, you acknowledge that you have read, understood, and agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.
2. Service Description
VoiceFlow AI provides an AI-powered voice communication platform that enables:
Inbound customer support automation with AI voice agents
Outbound sales campaign execution with intelligent calling
Lead management and enrichment through third-party integrations
Call recording, transcription, and analytics services
Compliance management tools for GDPR, TCPA, and telecommunications regulations
3. Account Registration and Eligibility
You must be at least 18 years old and legally capable of entering into binding agreements
You must provide accurate, complete information during registration and keep your account details updated
You are responsible for maintaining the confidentiality of your account credentials
Business accounts require valid business information and may be subject to verification
One person or entity may maintain only one account unless expressly authorized by us
4. Acceptable Usage Policy
You agree to use our services only for lawful purposes and in accordance with these terms. You may not:
Make calls without proper consent or in violation of Do Not Call regulations
Use our services for harassment, spam, or fraudulent activities
Attempt to circumvent our security measures or rate limits
Upload malicious content or attempt to compromise our systems
Violate any applicable telecommunications laws or regulations
Impersonate others or provide false identity information
Use our services to compete directly with our business model
5. Voice Calling and Compliance
Call Consent and Compliance:
You are responsible for obtaining proper consent for all outbound calls made through our platform
You must comply with TCPA, GDPR, and local telecommunications regulations in your jurisdiction
You must maintain and honor Do Not Call lists and opt-out requests
You agree to indemnify VoiceFlow against any compliance violations or regulatory fines resulting from your use
Call Recording and Data:
All calls may be recorded for quality assurance, AI training, and compliance purposes
You must inform call participants about recording where required by law
Call data is processed according to our Privacy Policy and applicable data protection laws
6. Third-Party Integrations
Our platform integrates with third-party services including Clay.com, ReTell, and OpenRouter. You acknowledge that:
Third-party services operate under their own terms and privacy policies
We are not responsible for third-party service availability or performance
You must comply with third-party service terms when using integrated features
Integration costs and usage limits may apply based on your subscription plan
7. Subscription Plans and Billing
Payment Terms:
Subscription fees are billed in advance according to your chosen plan
All fees are non-refundable except as required by law or our refund policy
Usage-based charges (per-call fees) are billed monthly in arrears
Accounts may be suspended for non-payment after appropriate notice
Plan Limits:
Each subscription tier has usage limits for calls, storage, and features
Overage charges may apply if you exceed plan limits
We reserve the right to modify pricing with 30 days advance notice
8. Data Ownership and Security
Your Data:
You retain ownership of all data you upload or generate through our platform
You grant us a license to process your data solely to provide our services
You are responsible for the accuracy and legality of data you provide
We implement industry-standard security measures but cannot guarantee absolute security
Our Intellectual Property:
VoiceFlow AI platform, AI models, and proprietary technology remain our exclusive property
You receive a limited, non-exclusive license to use our services according to these terms
Reverse engineering, copying, or creating derivative works is strictly prohibited
9. Service Availability and Support
We strive for 99.9% uptime but do not guarantee uninterrupted service availability
Scheduled maintenance will be communicated in advance when possible
Support is provided according to your subscription tier with response time commitments
Emergency support is available for critical service disruptions
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
OUR TOTAL LIABILITY for any claims related to our services shall not exceed the amount you paid us in the 12 months preceding the claim
WE ARE NOT LIABLE for indirect, incidental, consequential, or punitive damages
WE ARE NOT RESPONSIBLE for third-party service failures, telecommunications network issues, or force majeure events
COMPLIANCE VIOLATIONS resulting from your use are your sole responsibility
11. Indemnification
You agree to indemnify and hold VoiceFlow AI harmless from any claims, damages, or expenses (including legal fees) arising from:
Your use of our services in violation of these terms
Violations of telecommunications laws or regulations
Infringement of third-party rights through your use of our platform
False, misleading, or unlawful content you provide or generate
12. Termination
By You:
You may terminate your account at any time through your account dashboard
Termination does not relieve your obligation to pay outstanding fees
Data export tools are available for 30 days after termination
By Us:
We may suspend or terminate accounts for violations of these terms
We may terminate service with 30 days notice for business reasons
Immediate termination may occur for serious violations or legal requirements
13. Modifications to Service and Terms
We may modify our services to improve functionality or comply with legal requirements
Material changes to these terms will be communicated 30 days in advance
Continued use after changes constitutes acceptance of modified terms
Price changes require 30 days advance notice
14. Dispute Resolution
For Business Customers:
Disputes will be resolved through binding arbitration under the rules of the London Court of International Arbitration
Claims must be brought individually and not as part of a class action
Emergency injunctive relief may be sought in courts of competent jurisdiction
15. Governing Law and Jurisdiction
These terms are governed by the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in London, England.
16. International Use
If you use our services outside the UK, you are responsible for compliance with local laws and regulations. Some features may not be available in all jurisdictions due to legal restrictions.
17. Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, telecommunications failures, or government actions.
18. Entire Agreement
